A Letter of Wishes is a non-binding side document that can be incredibly helpful for fiduciaries or others interpreting and administering trusts and other estate planning instruments. Such a communication from an instrument’s creator can provide an important opportunity to clarify intentions, even from beyond the grave. On the other hand, if done poorly, such a document can produce chaos and even litigation.
